Terms of Service - HeyDevJob

1. Acceptance of Terms

By accessing or using HeyDevJob (the "Service", operated by HeyDevJob in Florida, USA), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

HeyDevJob is a hands-on engineering practice platform. Users debug real broken systems inside live, isolated cloud workspaces. The Service provides:

Ticket-based debugging challenges across roles (DevOps, Backend, Security, Data, AI/ML, Kubernetes) and difficulty levels (Junior, Mid, Senior)
A per-user, namespace-isolated cloud workspace with terminal, editor, and an AI assistant ("James")
A portfolio system showing completed challenges
Free and Pro subscription tiers

3. Eligibility and Account Registration

You must be at least 13 years old to use HeyDevJob. To subscribe to Pro, you must be at least 18 years old, because Pro involves billing and the legal capacity to enter a contract. By creating an account, you represent that you meet these age requirements.

You agree to:

Provide accurate registration information
Keep your account credentials secure
Notify us promptly of any unauthorized account use
Be responsible for all activity under your account
Not share your account with others

4. Acceptable Use Policy

You agree not to:

Use the Service for any illegal purpose or in violation of any laws
Attempt to gain unauthorized access to other users' accounts, workspaces, or systems
Use the workspace environments for cryptocurrency mining
Host malicious software or conduct attacks from workspace environments
Attempt to attack, probe, or access other users' workspace environments
Use workspaces to scan, attack, or exploit external systems or networks
Share account credentials with others
Reverse engineer or attempt to extract source code from the Service
Interfere with or disrupt the Service or servers
Use automated tools to scrape content or abuse the platform

Workspace environments are sandboxed and isolated. Any attempt to escape the sandbox, access other users' workspaces, or use the environment for purposes other than completing assigned tickets is a violation of these Terms.

5. Workspace Environments

Workspace environments are provided for completing assigned coding challenges only. We reserve the right to:

Monitor workspace usage for security and compliance
Terminate workspaces that violate the Acceptable Use Policy
Limit workspace resources based on your subscription tier
Stop workspaces after 30 minutes of inactivity and delete them entirely after 14 days of inactivity

The Service is a learning platform; do not store anything in a workspace that you can't afford to lose.

6. Your Content and Data

The Service and its original content, features, and functionality (including the ticket library, the AI assistant, and the platform code) are owned by HeyDevJob and protected by international copyright, trademark, and other intellectual property laws.

Code you write in workspaces to complete challenges is yours. We do not claim ownership of any code, solutions, or content you create. By using the Service, you grant us a limited license to store, process, and display that data solely for the purpose of providing the Service to you.

When you chat with the AI assistant or the homepage demo bot, the messages you send may be processed by a third-party LLM provider (see our Privacy Policy). Do not send confidential information in those chats.

7. Payment, Subscriptions, and Refunds

Pro subscriptions are sold at the price listed on the pricing page (currently $20/month or $200/year), billed in advance on a recurring basis. By subscribing, you agree that:

Subscription fees are charged automatically to your payment method on each billing cycle
Your subscription auto-renews until you cancel it from Settings
We may change pricing for future billing cycles with 30 days' notice
You can cancel at any time; you keep Pro access until the end of the billing period you've paid for

Refund policy: Full refund within 7 days of a Pro subscription purchase, no questions asked. After 7 days, refunds are handled case by case. To request a refund, email support@heydevjob.com.

Referral program: Every account has a unique referral code. If a new user signs up via your link and then upgrades to Pro, you earn one free month of Pro (applied as a credit on your next Stripe invoice and an extension of your Pro entitlement). The referred user receives 25% off their Pro subscription via a Stripe coupon. The program is offered at our discretion and may be modified or ended for new referrals at any time; rewards already granted are not retroactively changed.

8. Account Termination

You may delete your account at any time from Settings.

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties. This includes but is not limited to:

Attempting to access or attack other users' workspaces
Using the platform for malicious purposes
Abusing workspace resources (mining, hosting, external attacks)
Repeated violations of the Acceptable Use Policy

Upon termination, your workspace data is deleted. If you have an active Pro subscription and your account is terminated for abuse, no refund will be issued.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free. The AI assistant may produce inaccurate or incomplete information; treat its output as a learning aid, not authoritative advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYDEVJOB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

Our total cumulative liability to you for any claims arising from or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 50. The Service is a learning platform and is not intended for production workloads.

11. Indemnification

You agree to indemnify and hold HeyDevJob harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law provisions. Any dispute arising from or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

13. General

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and HeyDevJob regarding the Service.
No assignment: You may not assign or transfer your rights under these Terms without our prior written consent; we may assign these Terms freely.
Electronic communications: You consent to receive communications from us electronically (email, in-Service notices). These satisfy any legal requirement for written communication.
No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.

14. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or through the Service at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
